Police say the man was heading down to the lobby of the Dakota on Jan. 12 when the elevator coincidentally stopped on Ono’s floor. She got in. The tourist didn’t even recognize John Lennon’s widow.

According to AP, the man was detained when he got out at the lobby because security had spotted him on the roof. Authorities say he went there to take photos.

His case is on track for dismissal if he completes a day of community service within six months.

His attorney did not immediately return a call for comment.
